O texto procura recensear algumas das fontes de um discurso de espécie cética sobre o problema da atribuição de qualidades estéticas a objetos: o maior propósito deste conjunto deve entender-se como sendo um ataque à origem perceptiva dos fatos sensíveis. O autor recorre para tanto aos marcos do diálogo entre a fenomenologia e a filosofia analítica, sobretudo com G. Ryle, assim como às interrogações de L. Wittgenstein sobre o estatuto da investiga- ção estética: nestes âmbitos, identifica o problema da imagem (...) como fato perceptivo à necessidade de uma descrição gramatical dos juízos que envolvem estas experiências. O texto indica, finalmente, no âmbito dos escritos anti-cartesianos de Ch. S. Peirce às fontes de uma teoria do estético como filosofia da discursividade aplicada aos juízos perceptivos: sua teoria semiótica, em verdade, constituiria uma transformação radical do problema da inferência, na dire- ção de uma teoria das formas ampliativas, ou sintéticas, do entendimento (a justificação para a validade dos procedimentos indutivos e hipotéticos para a ciência e para a descrição dos juízos denotativos). Through an examination of the aesthetic ideas of the Konstanz School (in particular, in the texts of Wolfgang Iser and Hans Robert Jauss), we intend to make an inflection on the usual links between communication and the aesthetic experience - in the way they were traditionally encoded, as aspects of a critique of extreme mediatization processes, in the late stages of capitalism, illustrated by the philosophical ideas of the Frankfurt School (especially in the writings of Theodor W. Adorno and Walter (...) Benjamin). We set up as signs of this inflection the proposal for a rehabilitation of phenomena such as the “aesthetic effect” (in Iser) and “catharsis” (in Jauss), as elements that combine affective states of the aesthetic receptivity of works of art with their potential for communicability, proposing from there another type of connection for the appreciation of phenomena, processes and communicational products, in an aesthetic key. No presente artigo pretendemos apresentar o conceito de violência-poder em Walter Benjamin (1892 – 1940), com base no ensaio intitulado Crítica do Poder, Crítica da Violência [Zur Kritik der Gewalt] . Utilizamos como ponto de partida da crítica aqui em questão, a consideração da violência-poder no movimento próprio do texto de Walter Benjamim. Nesse sentido, esta exposição tem a seguinte seqüência: a) A recusa crítica dos pressupostos metodológicos do jusnaturalismo e do positivismo jurídico; b) A definição do procedimento da (...) filosofia da história para estabelecer os critérios para uma avaliação do poder-violência; c) A identificação de dois princípios inerentes ao direito: a violência instauradora da lei ( Rechtsetzende Gewalt ) e a violência mantenedora da lei ( Rechtsendhaltende Gewalt ). A partir daí, estabelecemos as seguintes suspeitas ou hipóteses: 1) O direito ou poder jurídico possui uma forma paradoxal de atuação, segundo as dimensões, instituidora e mantenedora do poder- violência, ou seja, na medida em que ele se faz valer, ele cria a sua própria suspensão, produz a exceção. 2) Essa contradição não se explicita na letra da lei, não se explica pelo seu caráter formal, mas apenas na realidade no sentido histórico abordado por Benjamin. This paper defends a contextualist approach to epistemic injustice according to which instances of such injustice should be looked at as temporally extended phenomena (having developmental and historical trajectories) and socially extended phenomena (being rooted in patterns of social relations). Within this contextualist framework, credibility excesses appear as a form of undeserved epistemic privilege that is crucially relevant for matters of testimonial justice. While drawing on Miranda Fricker's proportional view of epistemic justice, I take issue with its lack of attention (...) to the role that credibility excesses play in testimonial injustices. I depart from Fricker's view of the relation between credibility excesses and credibility deficits, and I offer an alternative account of the contributions that undeserved epistemic privileges make to epistemic injustices. Then, through the detailed analysis of To kill a mockingbird, I elucidate the crucial role played by the social imaginary in creating and sustaining epistemic injustices, developing an analysis of the kind of social blindness produced by an oppressive social imaginary that establishes unjust patterns of credibility excesses and deficits. While in agreement with Miranda Fricker’s context-sensitive approach to hermeneutical injustice, this paper argues that this contextualist approach has to be pluralized and rendered relational in more complex ways. In the first place, I argue that the normative assessment of social silences and the epistemic harms they generate cannot be properly carried out without a pluralistic analysis of the different interpretative communities and expressive practices that coexist in the social context in question. Social silences and hermeneutical gaps are misrepresented if (...) they are uniformly predicated of an entire social context, instead of being predicated of particular ways of inhabiting that context by particular people in relation to particular others. I contend that a more nuanced—polyphonic—contextualization offers a more adequate picture of what it means to break social silences and to repair the hermeneutical injustices associated with them. In the second place, I argue that the particular obligations with respect to hermeneutical justice that differently situated subjects and groups have are interactive and need to be determined relationally. That is, whether individuals and groups live up to their hermeneutical responsibilities has to be assessed by taking into account the forms of mutual positionality, relationality, and responsivity (or lack thereof) that these subjects and groups display with respect to one another. The central argument is developed through an examination of what in race theory and in contemporary epistemologies of ignorance has been termed “white ignorance”; that is, the kind of hermeneutical inability of privileged white subjects to recognize and make sense of their racial identities, experiences, and social positionality. The author challenges the view that birth cannot be a morally relevant fact in the process of development from zygote to child. He reviews specific arguments against giving any moral significance to the fact of birth. Drawing on recent work in developmental psychology, he contends that the lives of neonates can have a level of self-consciousness that confers moral significance but can only be possessed after birth. He shows that the position he has argued for provides a framework within which (...) the move from the moral validity of aborting sentient fetuses to the moral validity of infanticide might be resisted. He concludes that arguments suggesting that birth can be morally significant support the view that the acquisition of moral significance is a gradual and multilayered phenomenon. (shrink)

How precisely to understand and evaluate counterfactuals can be an intricate issue. The aim of this article is to examine a new set of difficulties for evaluating counterfactuals that arise in the context of the dynamical spacetimes described by the theory of general relativity (GR). The initial value formulation provides us with a methodology to pin down the specific combination of features of the theory at the origin of the difficulties, namely, non-linearity and certain non-local aspects (typically captured by ellipticity (...) at the analytical level), in particular when combined with the global and/or quasi-local character of physical quantities in GR. Finally, we connect the philosophical question about counterfactuals with concrete applied physical issues in GR about extracting meaningful predictions by constructing appropriate initial data sets, leading us to question the very suitability of the Cauchy approach to fully account for the explanatory power of the theory. We argue that there is no general theory of explanation that spans the sciences, mathematics, and ethics, etc. More specifically, there is no good reason to believe that substantive and domain-invariant constraints on explanatory information exist. Using Nickel (Noûs 44(2):305–328, 2010 ) as an exemplar of the contrary, generalist position, we first show that Nickel’s arguments rest on several ambiguities, and then show that even when these ambiguities are charitably corrected, Nickel’s defense of general theories of explanation is inadequate along (...) several different dimensions. Specifically, we argue that Nickel’s argument has three fatal flaws. First, he has not provided any compelling illustrations of domain-invariant constraints on explanation. Second, in order to fend off the most vehement skeptics of domain-invariant theories of explanation, Nickel must beg all of the important questions. Third, Nickel’s examples of explanations from different domains with common explanatory structure rely on incorrect formulations of the explanations under consideration, circular justifications, and/or a mischaracterization of the position Nickel intends to critique. Given that the best and most elaborate defense of the generalist position fails in so many ways, we conclude that the standard practice in philosophy (and in philosophy of science in particular), which is to develop theories of explanation that are tailored to specific domains, still is justified. Regulatory science, which generates knowledge relevant for regulatory decision?making, is different from standard academic science in that it is oriented mainly towards the attainment of non?epistemic (practical) aims. The role of uncertainty and the limits to the relevance of academic science are being recognized more and more explicitly in regulatory decision?making. This has led to the introduction of regulation?specific scientific methodologies in order to generate decision?relevant data. However, recent practical experience with such non?standard methodologies indicates that they, too, may be (...) subject to important limitations. We argue that the attainment of non?epistemic values and aims (like the protection of human health and the environment) requires not only control of the quality of the data and the methodologies, but also the selection of the level of regulation deemed adequate in each specific case (including a decision about which of the two, under?regulation or over?regulation, would be more acceptable). Finalmente, concluye con una propuesta restauradora del concepto por medio de la experiencia. This paper deals with the question of the conflict of constitutional rights with regard to basic rights. Two extreme accounts are outlined: the subsumptive approach and the particularistic approach, that embody two main conceptions of practical rationality. Between the two approaches there is room for a range of options, two of which are examined: the proportionalist approach, which conserves the scope of rights restricting their stringency, and the specificationist approach, which preserves the stringency of rights restricting their scope. In this article, we propose a philosophical exploration on the main problems involved in two neurorights that concern autonomous action, namely free will and cognitive liberty, and sketch a possible solution to these problems by resourcing to a holistic interpretation of human actions. First, we expose the main conceptual and practical issues arising from the neuroright to “free will,” which are far from minor: the term itself is denied by some trends participating in the neurorights debate, the related concept of (...) ultimate control is also disputed, the understanding of free will depends on cultural context, and the exercise of being free to act in several domains may be covered by other regulations. Second, we analyze the historical origin of cognitive liberty, its current status, and its relation with free will. Third, we criticize the concept of decision in mainstream action theory and propose to conceive action as a unified process constituted by three explanatory, non-sequential dimensions: intention, decision, and action realization. Fourth, we discuss two possible cases involving neurotechnologies and suggest ways to interpret them according to a unified framework in which free will and cognitive liberty fall under a single neuroright to personal autonomy. Finally, we outline a recommendation to introduce freedom of thought and personal autonomy as complementary neurorights to protect both the internal and external dimensions of thought and action. This paper argues that narrative elements from the science fiction (SF) literary genre are used in the discourse of Nanoscience and Technology (NST) to bridge the gap between what is technically possible today and its inflated promises for the future. The argument is illustrated through a detailed discussion of two NST texts. The current economic crisis is forcing us to reflect on where we have gone wrong in recent years. In the search for responsibilities some have looked to Business Schools and Administration Departments. It is surprising that this situation has come about despite the fact that Business Ethics and Social Corporate Responsibility have been taught in business schools for years. Without wanting to place all the blame on higher education institutions, but from a critical perspective and assuming responsibility, we believe it (...) is necessary to reflect rigorously on how to train leaders for the future and how we can best educate responsible Managers. In this article our objective is to reflect on the two factors which influence the training of responsible Managers: management discourse theory and the ethos of the institutions training future Managers. The central point of our article will be to argue for the need to develop an institutional ethos in Administration Faculties and business schools which is consistent with the responsibility discourse we propose and with the aim of providing high quality technical and moral training. Our central argument is that institutional ethos has enormous educational power and that the moral climate of an institution has a major influence on students' ideas, values and behaviours. The second argument for this main point is that corporate ethos can be managed and modulated. It is a process of cultural change which requires time and the setting up of specific initiatives to achieve the organisation that we want. (shrink)

The paper deals with the interpretation of Wittgenstein's views on the power of occurrent mental states to sort objects or states of affairs as in accord or in conflict with them, as presented in the rule-following passages of the Philosophical Investigations. I shall argue first that the readings advanced by Saul Kripke and John McDowell fail to provide a satisfactory construal of Wittgenstein's treatment of a platonist account of this phenomenon, according to which the sorting power of occurrent mental states (...) is to be explained by reference to the mind's ability to grasp universals. I contend that the argument that Kripke extracts from Wittgenstein's discussion doesn't succeed in undermining the platonist position. Then I argue that McDowell's reading exhibits a more serious shortcoming: the position that he ascribes to Wittgenstein is indistinguishable from the platonist account. Then I put forward a proposal as to how to articulate the relationship between Wittgenstein's views and the platonist position. (shrink)

Pedro de Toledo’s translation, Enseñador e Mostrador delos Turbados, is the earliest and most extensive philosophical text to appear in Spanish. The first translation into a vernacular language of RaMBaM’s Guide for the Perplexed is presented in Ms. 10289 of the Biblioteca Nacional, Madrid. The text seems an intellectual battle-field. It presents some interesting and peculiar characteristics at once: a text covered with glosses of the translator himself, and comments, variant translations, philosophical and theological disagreements, the use of rabbinic and (...) scriptural sources, by an anonymous critical commentator. These discrepancies show how the sensitive nature of the Maimonides ideas demands a particular hermeneutics, and offers an interesting view about the Spanish Jewish controversy in the fifteenth century. La figura de Yiisuf (José) desempeña un papel estelar en la obra de Ibn 'Arabi, en tanto que paradigma de belleza, señor del mundo simbólico y profeta del vasto campo de la Imaginación. En el presente articulo se hace un seguimiento de dicha figura desde la producción juvenil de al-Sayj-Akbar hasta sus escritos de madurez, observándose el progresivo enriquecimiento conceptual de la misma y el llamativo paralelismo existente entre la imagen coránica de Yiisuf y el propio místico murciano.

One current challenge for neuropsychologists is to design assessment methods capable of detecting cognitive deficits in the early or preclinical phases of Alzheimer’s disease (AD). The objective of this paper is to review the studies that have explored the use of the Face-Name Associative Memory Exam (FNAME) as a test for early diagnosis of AD. Studies looking at correlations between performance on the FNAME test and biomarkers in healthy people and studies comparing healthy controls and people with mild cognitive impairment (...) are reviewed. These studies are based on the evidence that AD’s pathological process begins years before the most visible clinical manifestations. We conclude that the FNAME test may be a valuable tool for early diagnosis but that some important questions remain to be resolved in future research. (shrink)

The only test theory used by workers in the field of testing special relativity to analyze the significance of their experiments is the proof by H. P. Robertson [Rev. Mod. Phys. 21, 378 (1949)] of the Lorentz transformations from the results of the experimental evidence. Some researchers would argue that the proof contains an unwarranted assumption disguised as a convention about synchronization procedures. Others would say that alternative conventions are possible. In the present paper, no convention is used, but the (...) Lorentz transformations are still obtained using only the results of the experiments in Robertson's proof, namely the Michelson-Morley, Kennedy-Thorndike, and Ives-Stilwell experiments. Thus the revised proof is a valid test theory which is independent of any conventions, since one appeals only to the experimental evidence. The analysis of that evidence shows the directions in which efforts to test special relativity should go. Finally it is shown how the resulting test theory still has to be improved for consistency in the analysis of experiments with complicated experimental setups, how it can be simplified for expediency as to what should be tested, and how it should be completed for a missing step not considered by Robertson. The study examined the level of moral reasoning of first-year university students in Papua New Guinea; 583 students participated by answering one of the exercises or dilemmas formulated by Kohlberg. The analysis of data primarily focused on what the general level of moral reasoning of the students might be and whether there were differences in their levels of moral reasoning on the basis of gender, culture and religious affiliation. The study showed that around 50 per cent of both male and (...) female students came within the first level, but in the second stage of moral reasoning. Around 25 per cent of both genders came under the stage 4, that is, the law and order stage. A t-test comparison revealed no significant difference between the genders in their moral reasoning. The ‘faculty’ that the students belonged to is the only variable that indicated a statistically significant effect F = 2.159, p = 0.030, est η2 = 0.014923 on the level of moral reasoning. All other variables such as age, religion and the province that the students came from did not show a significant effect. Two new dimensions, ‘reference to God’ and the ‘need for negotiation’, in moral reasoning emerged from the study. (shrink)

This project attempts a joint reading of the work of Friedrich Nietzsche and Frantz Fanon. This task, however, is problematic because this body of work is in tension or contradictory. These problems are so acute that a careful reading method is necessary to successfully carry out this reading. In order to facilitate this reading I elaborate and apply a particular philosophical methodology, Mestizaje. The methodology is intended to address works that are contradictory by attempting to read the texts as they (...) are presented while at the same time balancing their positions. The goal is to honestly reflect the thought of each thinker and to illuminate a perspective that incorporates but transcends their respective positions. What the application of Methodological Mestizaje finds is that while Nietzsche and Fanon stand in tension to one another, their respective works share several interesting and important convergences. In particular, they share thoughts on ressentiment, morality and violence. With ressentiment, Nietzsche creates the concept and two manifestations of it, while Fanon works with the concept to develop a third manifestation of this form of moral valuation. Furthermore, their works share the view that morality and violence are fundamental to understanding the origin, development and possible overcoming of a morality. This work contributes to the area of Africana Studies by offering a picture of Nietzsche that addresses concerns of these areas of study. Additionally, Methodological Mestizaje intends to follow in the tradition of non-ideal theory. Finally, while each thinker contributes to the discussion of ressentiment, morality and violence, their positions taken together reveal a broad and thorough perspective on colonialism and its concomitant morality, including their inception, and consequent progression and persistence in the current world. El problema con el que se abre este texto es el de la exclusión de los testimonios de la biblioteca filosófica y el objetivo será sostener que dichos textos pueden ser incluidos. Para ello se intentará, primero, desestabilizar la distinción entre texto filosófico y no-filosófico. Luego, se buscará poner de manifiesto que los testimonios son un modo de expresión que es coherente con una determinada concepción de filosofía. En tercer lugar, se pretende abrir la posibilidad de un discurso filosófico no-proposición (...) en los testimonios. Finalmente, se pondrá de manifiesto que lo que hay en los testimonios son imágenes y que ellas deben ser interpretadas en tanto que tales para poder acceder a su saber filosóficos. (shrink)

This paper comprises an analysis of an aspect of the history of psychiatric/psychological knowledge. The case in point is the transience of the notion of memory recovery in the context of childhood sexual abuse. By transience is meant that the concept of memory recovery apparently vanished and re-emerged despite the fact that its source, childhood sexual abuse, did not disappear. Such abuse is a fairly common phenomenon worldwide, whereas memory recovery seems to be temporally and locally limited. Is it possible (...) to say that psychiatric/psychological knowledge of memory recovery is also context-dependent and culture-bound? If so, what would this mean in relation to the applicability of this knowledge? (shrink)
